Summary of Key Terms

Prepaid Digital Service Credit: GateYourWay operates on a prepaid usage model denominated in USD. Tokens and generations are billed based on measured consumption.

Refund Policy: Consumed credits are non-refundable. Unused paid balances can be refunded within 14 days of deposit upon written request to support@gateyourway.com.

Content Standards & AUP: We strictly prohibit six categories of content: sexual/NSFW, violence/gore, hate speech, child sexual abuse material (CSAM), deepfakes/impersonation, and copyright infringement.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and GateYourWay ("GateYourWay", "we", "us", or "our"), governing your access to and use of the GateYourWay API, user dashboard, website (gateyourway.com), and related developer infrastructure (collectively, the "Services").

By creating an account, generating an API key, topping up your balance, or sending requests to our API endpoints, you expressly acknowledge that you have read, understood, and agreed to be bound by these Terms and our Acceptable Use Policy.

2. Eligibility and Account Registration

To access or use the Services, you represent and warrant that:

  • You are at least 18 years of age (or the legal age of majority in your jurisdiction).
  • You possess the legal authority to enter into these Terms on behalf of yourself or the entity you represent.
  • You will provide accurate, truthful, and up-to-date account credentials.
  • You are solely responsible for maintaining the confidentiality of your API keys (gyw-sk-...) and account authentication details. Any request authenticated with your API key is deemed authorized by you.
  • You are not located in, under the control of, or a national or resident of any country or region subject to comprehensive trade sanctions or embargoes (including United States OFAC, United Nations, or European Union sanctions), nor listed on any restricted persons or entities list.

3. Description of Services

GateYourWay provides developer-facing AI inference routing and API gateway services compatible with OpenAI and Anthropic API protocols. The Services enable programmatic text generation, chat completions, code synthesis, responses API, tool calling (function calling), Server-Sent Events (SSE) streaming, and image generation via supported foundational models.

We maintain an ephemeral, zero-storage proxy architecture: user prompt payloads and generated images are processed in-flight through memory buffers and are not permanently retained on server disks or used to train AI models.

4. Billing, Digital Credits, and Refund Policy

Digital Service Credits: The Services operate exclusively on prepaid digital service credits denominated in US Dollars ($ USD). Before dispatching API requests, you must purchase digital service credits through authorized payment channels.

Consumption & Pricing: Credits are debited in real time based on actual measured usage:

  • Language models: debited per 1,000,000 input tokens, output tokens, and explicit cache read/write tokens at published catalog rates.
  • Image models: debited per successful image generation or edit based on chosen dimensions and quality tiers.

Non-Refundability of Consumed Credits: Once digital service credit has been consumed by a successfully processed API response, stream, or generated image, that service is deemed fully delivered, completed, and non-refundable.

Refund Policy for Unused Paid Balances: You have the right to request a refund of unconsumed, paid wallet credits within fourteen (14) calendar days from the date of purchase. To request a refund, submit a written request to support@gateyourway.com referencing your account email and transaction ID. Approved refunds will be returned to the original payment method, minus non-recoverable third-party payment processing fees. Bonus credits, referral rewards, or promotional balances are non-refundable and hold no monetary cash value.

Disputes and Chargebacks: If you experience any billing discrepancies, you agree to contact us first at support@gateyourway.com for resolution. Initiating an unauthorized chargeback or payment reversal without prior notification constitutes a material breach of these Terms and will result in immediate account suspension.

5. Content Standards and Acceptable Use

Your use of the Services—particularly image generation and text inference—must strictly comply with our Acceptable Use Policy (AUP). We explicitly prohibit the generation, transmission, or dissemination of content across six prohibited categories:

1. Child Sexual Abuse Material (CSAM) & Exploitation Zero tolerance. Generating, uploading, or distributing child sexual abuse material or child exploitation content will result in immediate permanent termination, balance forfeiture, and immediate mandatory reporting to NCMEC and legal authorities.
2. Sexual & NSFW Content Sexually explicit material, pornography, non-consensual sexual content, erotica, and sexual solicitation.
3. Violence, Gore, and Self-Harm Graphic gore, bodily harm, decapitation, torture, incitement of violence, threats of physical harm, promotion of suicide or self-injury, and weapons instructions.
4. Hate Speech & Harassment Content promoting discrimination, hatred, slurs, defamation, harassment, doxxing, or stalking targeting protected groups based on race, religion, gender, sexual orientation, disability, or nationality.
5. Deepfakes & Impersonation Deceptive synthetic media of real persons created without consent, non-consensual intimate imagery, political election interference, or executive/official impersonation for fraud.
6. Intellectual Property Infringement Content that violates or misappropriates third-party copyrights, registered trademarks, patents, or trade secrets without lawful authorization.

6. Intellectual Property Rights

Your Content: You retain all right, title, and interest in and to the input prompts, text, code, and images that you submit to the Services.

Generated Outputs: To the extent permitted by applicable law and foundational model terms, GateYourWay assigns to you all its right, title, and interest in and to the outputs generated by the models in response to your lawful prompts.

GateYourWay Property: All software, documentation, website design, trademarks, service marks, logos, and proprietary infrastructure remain the exclusive intellectual property of GateYourWay.

7. Disclaimers and Warranties

THE SERVICES AND ALL ARTIFICIAL INTELLIGENCE GENERATED OUTPUTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Artificial intelligence models generate probabilistic outputs. GateYourWay does not guarantee that outputs will be accurate, complete, reliable, or free of bias or error. You are solely responsible for evaluating, verifying, and testing the accuracy and suitability of any output for your use cases before deploying or relying on it.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GATEYOURWAY, ITS OPERATORS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, REPUTATION, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SERVICES.

IN ALL CIRCUMSTANCES, GATEYOURWAY'S TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO GATEYOURWAY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

9. Suspension and Termination

You may terminate your account at any time by ceasing all use of the Services and requesting account deletion.

GateYourWay reserves the right to immediately suspend or permanently terminate your account and API access without prior notice if: (a) you violate these Terms or our Acceptable Use Policy; (b) your account is associated with fraudulent transactions or chargebacks; (c) your usage creates a security hazard or operational disruption for other users; or (d) we are required to do so by applicable law or governmental authority.

10. Modifications to Terms

We may amend these Terms periodically to reflect operational, legal, or technical changes. Amendments take effect immediately upon posting to this URL with an updated "Last Updated" date. Your continued access to or use of the Services after such changes constitutes acceptance of the revised Terms.

1. Принятие условий

Настоящие Условия обслуживания («Условия») представляют собой юридически обязывающее соглашение между вами («Пользователь», «вы») и GateYourWay («GateYourWay», «мы»), регулирующее доступ к API GateYourWay, личному кабинету, сайту (gateyourway.com) и сопутствующим сервисам (совместно — «Сервисы»).

Создавая аккаунт, генерируя ключ API, пополняя баланс или отправляя запросы к API, вы подтверждаете, что ознакомились с Условиями и Правилами допустимого использования (AUP) и полностью согласны с ними.

2. Требования к пользователю и регистрация

Для использования Сервисов вы подтверждаете и гарантируете, что:

  • Вам исполнилось не менее 18 лет (или вы достигли возраста совершеннолетия в вашей юрисдикции).
  • Вы обладаете необходимой дееспособностью для заключения данного соглашения.
  • Предоставляемые вами контактные данные актуальны и достоверны.
  • Вы несете полную ответственность за сохранность ваших API-ключей (gyw-sk-...). Любой запрос с вашим ключом считается совершенным от вашего имени.
  • Вы не находитесь в странах или регионах, подпадающих под действие всеобъемлющих международных санкций (включая санкции OFAC), и не включены в санкционные списки.

3. Описание сервисов

GateYourWay предоставляет маршрутизацию запросов к нейросетям по протоколам OpenAI и Anthropic API. Сервис обеспечивает текстовые диалоги (Chat Completions), responses API, вызовы инструментов (tool/function calling), потоковую передачу данных (SSE) и генерацию изображений.

Мы используем архитектуру с нулевым хранением на сервере: передаваемые промпты и сгенерированные изображения обрабатываются в оперативной памяти и не сохраняются на серверных дисках в виде постоянных файлов.

4. Тарификация, списания и правила возврата

Цифровой сервисный кредит: Работа ведется по предоплатной модели. Расчеты ведутся в долларах США ($ USD).

Списание: Средства списываются в реальном времени строго за фактически выполненные вычисления (входные, выходные и кэш-токены, либо фиксированная ставка за генерацию изображения согласно каталогу).

Невозвратность использованных услуг: Если запрос или генерация были успешно выполнены и доставлены клиенту, цифровой кредит считается полностью реализованным и возврату не подлежит.

Возврат неиспользованного баланса: Вы вправе запросить возврат неиспользованного остатка денежных средств в течение 14 календарных дней с момента пополнения, направив заявку на support@gateyourway.com. Возврат осуществляется тем же методом оплаты за вычетом комиссий платежных шлюзов. Бонусные и реферальные средства выводу и возврату не подлежат.

Чарджбэки: В случае возникновения вопросов по списаниям вы обязуетесь сначала обратиться в службу поддержки. Необоснованный чарджбэк влечет немедленную блокировку аккаунта.

5. Правила допустимого использования (AUP)

При использовании текстовых и визуальных моделей строго запрещено генерировать или передавать следующие 6 категорий материалов:

1. Детская порнография и эксплуатация (CSAM/CSAE) Нулевая толерантность. Немедленная вечная блокировка, аннулирование баланса и обращение в правоохранительные органы и NCMEC.
2. NSFW и сексуальный контент Порнография, откровенные сцены сексуального характера, интимный контент и секс-услуги.
3. Насилие, жестокость и причинение вреда Изображение увечий, пыток, расчленения, призывы к физической расправе, пропаганда суицида или самоповреждения.
4. Разжигание вражды и травля Дискриминация, оскорбления, травля и преследование по признакам расы, национальности, религии, пола или инвалидности.
5. Дипфейки и выдача себя за другое лицо Создание вводящих в заблуждение поддельных медиаматериалов с реальными людьми без их согласия, политические фальсификации, мошенничество.
6. Нарушение чужих интеллектуальных прав Нарушение авторских прав, товарных знаков или патентов третьих лиц без законных оснований.

6. Интеллектуальная собственность

Вы сохраняете права на ваши исходные промпты и загружаемые файлы. Права на результаты генерации, полученные по вашим законным запросам, принадлежат вам в объеме, предусмотренном применимым правом и условиями базовых моделей.

7. Ограничение ответственности

СЕРВИСЫ И РЕЗУЛЬТАТЫ ГЕНЕРАЦИИ ПРЕДОСТАВЛЯЮТСЯ НА УСЛОВИЯХ «КАК ЕСТЬ» («AS IS»). Модели искусственного интеллекта носят вероятностный характер; GateYourWay не гарантирует безошибочность или абсолютную достоверность сгенерированного текста или изображений.

Совокупная ответственность GateYourWay перед пользователем по любым претензиям ограничивается суммой, фактически уплаченной пользователем за услуги GateYourWay в течение предшествующих 12 месяцев.
